Waiving a deductible in Florida: §489.147

Florida wrote its deductible ban into the contractor licensing law itself, which tells you who it aims at: §489.147 disciplines contractors, with fines up to $10,000 per occurrence, for using deductible waivers, rebates or gifts to induce an insurance claim.

The inducement is the offense

Section 489.147(2)–(3) bans offering a rebate, gift, or deductible payment as an inducement to a property owner to file a claim. The marketing is the violation — the gift card at the door, the “sign today” rebate, the absorbed deductible in the ad. Each occurrence is separately finable, and discipline rides on the license itself: this is a DBPR problem, not just a consumer complaint.
